Welcome to FatahTech. These Terms of Service ("Terms") govern your access to and use of the website located at fatahtech.com (the "Site"), as well as any services we provide. By accessing the Site or engaging FatahTech for any services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

1. About FatahTech

2. Services We Provide

FatahTech offers a range of professional software development services, including but not limited to:

The specific deliverables, timelines, and scope of any project will be agreed upon between FatahTech and the client before work begins, typically through a written proposal or project agreement.

3. Use of the Website

The Site is provided for informational purposes. It allows visitors to learn about our services, view our portfolio, and get in touch with our team. No user account creation is required or available on the Site.

When using the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Site or its underlying systems
  • Introduce viruses, malware, or any other harmful code
  • Scrape, copy, or reproduce Site content without prior written permission

4. Payments

All FatahTech services are billed as one-time payments. The total cost of each project is determined during the proposal phase and agreed upon before any development work begins. Payment terms, including milestones (if applicable), will be outlined in the project agreement.

We accept the following payment methods:

  • Cash
  • Bank transfer

Clients are responsible for ensuring that payments are made on time as per the agreed schedule. Failure to make timely payments may result in a pause of development work until the outstanding balance is settled.

5. Refund Policy

All sales are final. Due to the nature of custom software development, where significant time, effort, and resources are invested from the start of a project, FatahTech does not provide refunds for any services rendered. We encourage all clients to thoroughly review the project scope and proposal before committing to a project engagement.

6. Intellectual Property and Ownership

Upon project completion and receipt of full payment, FatahTech transfers complete ownership of the custom code and software to the client. This includes all source code, design files, and other deliverables that were specifically created for the client as part of the project.

The following exceptions apply:

  • Third-party components: Any open-source libraries, frameworks, or third-party tools used within the project remain subject to their respective licenses. Ownership of these components does not transfer to the client.
  • Pre-existing tools: Internal tools, boilerplate code, or proprietary frameworks developed by FatahTech prior to the project engagement remain the property of FatahTech, though the client retains a perpetual license to use them within their delivered project.

All content on the FatahTech website (including text, graphics, logos, and design elements) is the intellectual property of FatahTech and may not be reproduced without written consent.

7. Limitation of Liability

All software, code, and services delivered by FatahTech are provided on an "as-is" and "as-available" basis. While we make every effort to deliver high-quality, thoroughly tested work, we do not warrant that the delivered software will be entirely free of bugs, errors, or interruptions.

To the fullest extent permitted by applicable law, FatahTech shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits or revenue
  • Business interruptions
  • Loss of data or information
  • Damages arising from software bugs, defects, or downtime

In no event shall FatahTech's total liability exceed the amount actually paid by the client for the specific project or service giving rise to the claim.

8. Client Responsibilities

To ensure successful project delivery, clients agree to:

  • Provide accurate and complete project requirements and specifications
  • Supply any necessary content, assets, or access credentials in a timely manner
  • Respond to requests for feedback and approval within reasonable timeframes
  • Make payments according to the agreed schedule

Delays caused by late client input, unclear requirements, or scope changes may affect project timelines and may incur additional costs.

9. Confidentiality

Both FatahTech and the client agree to treat all project-related information, business data, trade secrets, and proprietary materials as confidential. Neither party will disclose such information to any third party without the other party's prior written consent, unless required by law.

10. Termination

Either party may terminate a project engagement by providing written notice to the other party. In the event of termination:

  • The client will be billed for all work completed up to the date of termination.
  • Any deliverables completed and paid for will be handed over to the client.
  • Unpaid work will remain the property of FatahTech until full payment is received.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Dhaka, Bangladesh.

12. Changes to These Terms

FatahTech reserves the right to modify these Terms at any time. When changes are made, we will update the "Effective Date" at the top of this page. Continued use of the Site or our services after any changes constitutes your acceptance of the updated Terms. We recommend reviewing this page periodically.
